1. Scope

These Terms of Use govern the use of the Banqo mobile application (hereinafter "App") and the associated website banqo-app.de between Ahmad Al Hayawi, Senefelderstraße 12, 97080 Würzburg, Germany (hereinafter "we" or "Provider") and the users (hereinafter "you" or "User").

By downloading, installing, and/or using the App, you accept these Terms of Use. If you do not agree to these terms, you may not use the App.


2. Service Description

Banqo is an application for creating and managing invoices, estimates, delivery notes, and expenses for freelancers and small businesses. The App enables in particular:

All data is stored exclusively locally on the user's device. No transmission to our servers takes place, with the exception of optional features such as receipt scanning (Business plan only).


3. Free and Paid Features

4. User Obligations

You agree to use the App only within the framework of applicable laws and these Terms of Use. In particular, it is prohibited to:

You are solely responsible for ensuring that the documents created with the App (invoices, estimates, etc.) comply with applicable legal requirements, in particular VAT regulations.


5. Intellectual Property

The App, its content, design, source code, and all trademark and copyright rights are the intellectual property of the Provider or its licensors. You only receive a non-exclusive, non-transferable, revocable right of use for personal use of the App within the framework of these Terms of Use.


6. Availability and Changes

We strive to keep the App available at all times, but do not guarantee uninterrupted availability. We reserve the right to update, modify, or discontinue individual features of the App at any time, insofar as this is reasonable for the user.

We reserve the right to change these Terms of Use at any time with effect for the future. You will be informed of significant changes.


7. Liability

We are liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intentional or grossly negligent breach of duty.

In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.

Any further liability is excluded. In particular, we do not assume any liability for the accuracy or completeness of the documents created with the App. The legal and tax correctness of the created invoices is the responsibility of the user.

Since all data is stored locally on the device, we do not assume any liability for data loss due to device damage, loss of the device, or accidental deletion of the App. We recommend regular backup of your data.

9. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Insofar as you are a consumer with habitual residence in another EU country, the application of the mandatory consumer protection provisions of that country remains unaffected.

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
